Terms of Service

Effective Date: April 14, 2026

These Terms of Service (“Terms”) govern your access to and use of the Digital Arborist platform (“Service”), operated by Digital Arborist (“Company,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

1. Account Registration

To use Digital Arborist, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must be at least 18 years old and have the authority to bind your company to these Terms.

2. Service Description

Digital Arborist is a cloud-based tree service management platform that provides scheduling, job management, invoicing, crew management, customer relationship management, and related tools for arborist and tree service businesses.

3. Subscription and Billing

3.1 Free Trial

New accounts receive a 14-day free trial with access to all features. No credit card is required to start a trial.

3.2 Paid Plans

After the trial period, continued access requires a paid subscription. Subscription fees are billed monthly in advance. Current pricing is available at digitalarborist.com/pricing.

3.3 Payment

Payment is due at the beginning of each billing cycle. We accept major credit cards. Failed payments may result in service suspension after a 7-day grace period.

3.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access through the end of your current billing period. No refunds are provided for partial billing periods.

4. Your Data

4.1 Ownership

You retain full ownership of all data you enter into Digital Arborist, including customer records, job information, financial data, photos, and documents (“Your Data”).

4.2 License to Us

You grant us a limited license to store, process, and display Your Data solely for the purpose of providing and improving the Service.

4.3 Data Export

You may export Your Data at any time through the platform’s export features. Upon account termination, we will retain Your Data for 90 days, after which it will be permanently deleted.

4.4 Data Security

We implement industry-standard security measures to protect Your Data, including encryption in transit and at rest. However, no system is completely secure, and we cannot guarantee absolute security.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access accounts, systems, or data not belonging to you
  • Transmit malicious code or interfere with the Service
  • Resell or sublicense access to the Service without our written consent
  • Use the Service to send unsolicited communications in violation of applicable laws

6. Third-Party Integrations

Digital Arborist integrates with third-party services including QuickBooks Online, Google Workspace, and payment processors. Your use of these integrations is subject to the respective third party’s terms of service. We are not responsible for third-party service availability or data handling.

7. Intellectual Property

The Service, including its design, code, documentation, and branding, is owned by Digital Arborist and protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL ARBORIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, REGARDLESS OF THE THEORY OF LIABILITY.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify and hold harmless Digital Arborist from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third party’s rights.

11. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

12. Termination

We may suspend or terminate your access if you violate these Terms, fail to pay subscription fees, or if required by law. Upon termination, your right to use the Service ceases immediately, subject to the data retention period in Section 4.3.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.
